OVERALL OBJECTIVE OF JOB
Employee will generally represent the Agency on other legal matters as assigned by the Agency Solicitor, Agency Administrator or the Administrator’s designee.
Employee will represent the Agency before the Dauphin County Juvenile Court on the following: review hearings, dependency hearings, status conferences, emergency shelter care hearings, dispositional review hearings, and permanency reviews. Additionally, Attorney shall represent the Agency in effectuating inter-county transfers. This employee will represent the Agency in Dauphin County Orphans’ Court for cases of involuntary termination of parental rights and associated appeals.
ESSENTIAL FUNCTIONS OF JOB
- As assigned by the Agency Solicitor, Agency Administrator or the Administrator’s designee, represent Agency when Agency staff are subpoenaed and fully prepare said staff.
- As assigned by the Agency Solicitor, Agency Administrator or the Administrator’s designee, advise the Agency about statutory or regulatory compliance changes.
- Establish regularly scheduled times at the Agency’s facility to prepare Agency staff for any court hearing at which said staff may be required to testify.
- Attorney shall immediately report all incidents of potential liability to the Agency Administrator or the Administrator’s designee.
- Perform those assignments that may be assigned by the Dauphin County Solicitor.
- Perform those assignments that may be assigned by the Human Services Solicitor.
- Report to the Dauphin County Solicitor’s Office on all material matters in such manner and upon such schedule, as the Dauphin County Solicitor shall from time to time direct.
- As assigned by the Agency Administrator or the Administrator’s designee, represent the Agency by reviewing document production requests directed at the Agency and filing objections or motions to quash where appropriate. All open records law requests shall be coordinated with the Dauphin County Solicitor’s Office and the designated Dauphin County Open Records Officer.
- Attorney shall provide own email capabilities and shall promptly respond to all email from agency staff, the Agency Administrator and the other Agency attorneys.
- Report to the Dauphin County Solicitor’s Office on all material matters in such manner and upon such schedule, as the Dauphin County Solicitor or the Human Services Solicitor may from time to time direct.
OTHER DUTIES OF JOB
- Employee must be available for consultation, including after-hours, by telephone, if needed.
- To the extent required when Agency clerical support is insufficient for any reason, Attorney shall provide own clerical support.
- Report to the Dauphin County Solicitor’s Office on all material matters in such manner and upon such schedule, as the Dauphin County Solicitor shall from time to time direct.
- Report to the Human Services Solicitor on any matter and in any manner and upon such schedule, as said Solicitor/Special Counsel shall from time to time direct.
SUPERVISION RECEIVED
Supervision and evaluation will be conducted through periodic meetings and reviews of work results.
SUPERVISION GIVEN
This position does not supervise staff.
WORKING CONDITIONS
- Works indoors in office area with adequate lighting and ventilation, but subject to fluctuations in temperatures.
- Average indoor exposure to dust/dirt.
- Works in conditions of potential outbursts or disruptive behavior of clients.
- Some outside event work subject to weather and outside environmental conditions.
PHYSICAL AND MENTAL REQUIREMENTS
- Must possess ability to record, convey and present information, explain procedures and follow instructions.
- Must be able to sit for long periods throughout the workday, with intermittent periods of standing, walking, bending, twisting and reaching necessary to carry out duties of job.
- Sedentary work with occasional lifting/carrying of objects with a maximum weight of ten pounds.
- Must be able to cope with the physical and mental stress of the position.
- Must be able to move frequently throughout the work day as needed to carry out essential job duties.
- Must be able to pay close attention to details and concentrate on work.
QUALIFICATIONS
A. EDUCATION/TRAINING
Graduation from an approved school of law and certificate of admission to the Bar of the Supreme Court of Pennsylvania;. Continued employment is conditional upon the maintaining such certificate of admission.
Other Requirements:
At the time of hire, a valid driver’s license and positive driving record, a favorable criminal background check, child abuse and FBI clearances, as well as favorable references are required. The applicant must provide proof of a valid Pennsylvania driver’s license within 60 days from the date of hire. An alternative form of identification will be accepted if you are not eligible to receive a Pennsylvania driver’s license under 67 PA. Code § 83 and driving is not an essential function of the position.
KNOWLEDGE, SKILLS AND ABILITIES REQUIRED
- Knowledge of the application of legal principles to individual cases or problems.
- Knowledge of federal and state laws and regulations affecting the administration of the programs to which assigned.
- Knowledge of court procedures and rules of evidence.
- Ability to understand and interpret constitutional provisions, statutes, administrative regulations, and precedents.
- Ability to analyze facts, evidence, and precedents and arrive at logical interpretations.
- Ability to set forth findings of facts and decisions in written forms.
- Ability to prepare legal documents and records.
